    Keep @IronPaw in your deepest thoughts and prayers. He was incarcerated for protesting using trumped up allegations and is being held in shackles daily alongside others convicted of very serious crimes. They feel confident that justice will win out, but it does not appear to be an overnight battle and as of right now it looks like he won’t have another chance in court until January.     He is strong and mentally built like a tank. A massive tip of the hat to him for standing resolute with his convictions. Hoping for some positive news and changes soon. I’m glad his family and wife can be his voice, even when they’re trying to stifle him.

    Read his post, hope he’s doing good. While they say challenge everything... this is both sides i challenge but just bringing up what is written in the LA times...

    i looked it up and this morning he had $1Mill bail and had court today... after court he now does not have a bail amount now. Seems they actually have something on him? Or are trying to set a example with him. I feel bad for him, says his next court date isn’t until January. Keep him in your thoughts

    This was a response I’d just given to someone that brought up the article to me, as well: “I saw the article. Definitely a scary amount of bail and a serious allegation. I did see that his family stated he’s being pumped on false charges, which isn’t out of the realm of cops in general. Happens quite often. I’m inclined to believe if there was legitimacy to the charges; i.e. proof, he wouldn’t still be claiming innocence. Also seems weird to me for him to have an active warrant for his arrest on such a charge, but they wait until they catch him at a protest rally. He’s posted videos of them casing his house and following him for weeks; they could’ve picked him up at any point. But I’m also not adversed to people having to take responsibility for their actions.”

    Given his history of back and forth with local authorities since the protests, I wouldn’t at all be surprised if he’s being made an example. It happened to dozens of protesters in Downtown Phoenix. Held for 24 to 48 hours without bail and threatened with fines, given a court date, and all were dismissed and sent home. Definitely hoping for the best case scenario for him.

    Like I said, I am just questioning everything. Not that I don't believe in him or anything like that. just reporting what I saw, the changes to what I saw, its rather odd to see he had the option to bail, then that option taken off the table during his court hearing this morning.

    Oh, my response wasn’t meant as butting heads. I’m essentially agreeing with you, in that more information came out that some might not have seen. Just also stating my position with that new information, as well. It is a scary notion to have the bail option removed, and also a bit crazy his court date isn’t until January 8th.

    Everyone who was paying attention knew he was going to get arrested one way or another. I am sure he knew it as well.

    I just hope he made enough connections and friends among the protesting community to get legal and financial help for what he's going through now. Odds are he'll get Covid in jail too so I hope he gets through that safely as well.

    As far as the derailment charge goes I've seen that used against protesters in the past who stood on lightrail tracks or even just train tracks while protesting. There was a similar charge against people who protested in a bus tunnel if I recall correctly. No idea at all if that is the case here or not but that would be my assumption.

    I really appreciated the update on his IG from his family. He's a great dude and I have high hopes he'll bounce back.
    For all the protesting that he's been doing, an attempt to derail a train seems so out of place that I'm leaning towards that the charges are bogus.
    If any of you guys who are closer to him on this board, I'd love to help out in anyway I can so please continue bumping this thread with any new info. Thank you.

    Manny is a great dude, I hope he can see the light at the end of this tunnel and come out healthy and whole. I respect what he is fighting for, and just hope that it doesn't keep him or his wife from living the lives they both deserve as time goes on.

    Man, I am really sorry to hear this. The facts on the ground seem clouded at best, and these charges and lack of bail are real head scratchers, but I also have a pretty critical eye of the US "justice" system. I hope Manny can come out of this safe and healthy, and I will be pulling for him and his family in these tough times.

    This one goes for the other skullbrainers, (yeah, plural) that have taken time out of their day to send a PM to me (Bc I didn’t even know I was worth of the time to hear why Emmanuel is X, Y, or Z). I’m not here for that.

    I do not care the circumstances, I do not care about the articles y’all dig out from media stating the charges in the most legalize of ways. The justice system in the US is flawed and you taking a step to put the blame on those incarcerated is not the way to change that system. It weighs heavily against those of us in marginalized communities.

    One cannot in good faith think that Emmanuel is wrong here, especially those of us that have suffered greatly under the boots of cops and border patrol. Y’all stating that he is, makes one wonder what you think the last few months of intense protesting have been about.

    please, if you reach out to me to shit on another SBer when it comes to stuff like this, I am going to scratch my head and wonder why you are licking boots at this juncture. We’re here arguing about toys, not why a human life should be put away (it shouldn’t).

    I’m nobody. I feel I contribute here waaaay less than Emmanuel has done over the years. So when several take a moment to tell me I shouldn’t feel for him or his cause, I wonder why am I here at all. Because siding with those that support the oppression of the state is like siding with those that have shot, murdered, assaulted, and disappeared many I March for.

    I am really grateful the majority isn’t this, but it is still upsetting. I want no part of it.

    regardless of how much crap you’ve swung at Emmanuel and how much he has swung back, taking the piss on his situation or trying to justify his predicament is not what I am here for.

    Wow, just when I think SB and 2020 could not sink to new lows. Sorry to be reading this now. Can we all just put away the pitchforks and be a part of humanity, just for a bit? If not, by all means go play with your plastic dollies and tell them all of your problems; there's no need to unwind yourself on folks here. A lot of people here are dealing with serious real life issues, and enjoy the fraction of escape and friendship the board brings. If that is not your thing, and you have no sym/empathy, that's equally fine too, but no reason to turn it into a negativity sink. We're all here for toys right, which are supposed to be fun. Or you are doing it wrong.

    Exactly, anyone paying attention to his posts knew retaliation was coming. He knew it too and I’m sure he felt ready to deal with it, I hope he can stay strong in the reality now that it’s here. And what does derailing a passenger train even mean. Were they blocking tracks in protest, that’s my assumption. Trying to tip it like a car (seems impossible and dumb), putting dynamite on tracks like in a cartoon? The charge seems ridiculous and vague.
    Any way I commend his heart and resolve, I doubt anyone of us on this board has ever fought as hard for a cause as E.

    @JoeMan They dress up bullshit charges to sound legitimate and dangerous. I wouldn’t have guessed what they meant with the derailing, but I think waterbear nailed it perfectly. When people got arrested in Phoenix cops were marching towards protesters and cornering them against walls and cutting off streets, only then to claim they were violating curfew and partaking in “unlawful protests”. Everyone’s paperwork for the arrests was copy and pasted, word for word.

    From the last couple updates his family and wife have been able to relay for him, he seems to be holding strong, but obviously and rightfully disappointed and tired. I hope Meagan and his family get to bring him home soon.

    This news sucks and, as many have pointed out, is not surprising. Stand up to police thugs, get surveilled, get stepped on, always... and that's exactly why Emanuel was out there fighting. I'm hoping the best for his situation, and health and safety for him and his family.

    I bought some stuff from Manny right before all this happened. I was talking to his girlfriend and she asked if I got the toys and Manny was apologizing for not giving me a tracking number.

    Apologising. To me. While he was in prison.

    If that doesn't show you what kind of a caring, stand-up dude he is I don't know what will.

    We all may have disagreements and in some cases be polar opposites but you really can't talk ill of his character even if you hate his politics.

    'Paw was fighting against police brutality/injustice - not trains! Not once have I ever heard him speak poorly of trains. And even if he wanted to make a big scene TOTALLY UNRELATED to what he was fighting against, I can't think of a more difficult thing to do than DERAILING A FUCKING TRAIN! What a fucking 1930s thing to charge someone with. Why isn't filing false charges a felony? Not that it would even matter, since laws don't apply to cops.

    This situation is frustrating. I’m super wary of these so-called “train derailment” charges... it just sounds absolutely ridiculous. Protesting on or near train tracks seems way more likely, but cops love to tack crazy charges on people.
    There was a homeless guy who used to beg on the highway off-ramp to one of the most rich whitey towns near us. The police tried to charge him with “misuse of an off-ramp.” It involved a fine, as if a homeless dude could actually pay it. The police just wanted to get rid of him because he was black, and stuck-up rich snobs wanted him gone.
    I wouldn’t be surprised if this was a similar situation, where the police charged him for something that sounds worse than it really was. I just can’t imagine Emmanuel wanting to harm a whole train full of innocent passengers, it has zero to do with his goals. I think the police were just waiting to spot him doing something that they could nab him on.
    I just hope the truth comes out soon enough.

    Well shit. The charges are way more serious than I thought they would be. Possible life in prison. Apparently he was involved in a tug of war against cops with a coiled wire police barricade that they say he dragged over train tracks. Long story short he says he let go when he realized a train was coming and it could cause damage. Cops say he was trying to derail a train. They've already searched his home and confiscated his legally owned firearms but they wouldn't comment on anything else they found. I hope he has a great lawyer cause they are going at him hard with those charges.



    The Los Angeles County district attorney’s office has filed charges against a protester for allegedly attempting to wreck a train at the scene of a demonstration against the sheriff’s department — a case where the defendant’s attorneys have accused officials of gross exaggeration in retaliation for protest activity.

    Emanuel Padilla, a 34-year-old toy designer who lives in Hawthorne, was charged Monday with one felony count of a train wrecking attempt, which carries a maximum sentence of life without parole, and one felony count of unlawful obstruction of a railroad track, which carries a two- to four-year sentence.

    Padilla pleaded not guilty at an arraignment at the Compton courthouse Monday, where a judge denied bail.

    According to the sheriff’s department, the alleged incident occurred Nov. 15 at the intersection of Compton Boulevard and Willlowbrook Avenue in Compton — the location of a largely peaceful protest organized that afternoon to urge justice for Andres Guardado, an 18-year-old killed by a sheriff’s deputy in Gardena this summer.

    Padilla helped drag a metal cable across train tracks near the intersection, shortly before railroad crossing signals lit up and an alarm alerted that a train was coming, according to the district attorney’s office.

    A detective’s report on Padilla’s arrest describes how officials had placed a coiled wire barricade near the train tracks. As the protest drew to a close and most people had left, Padilla and two others began dragging the wire across the tracks, the report said.

    When deputies tried to pull the wire back, the two other individuals let go but Padilla briefly continued pulling, according to the account. It describes how he eventually lost his grip to the deputies’ tug, then continued crossing the tracks. Shortly after, a train passed by, the report said, noting that Padilla must have been aware of its approach.

    Padilla was arrested last Wednesday afternoon shortly after a small, peaceful protest near the home of L.A. Sheriff Alex Villanueva where demonstrators called for the department to release the names of deputies involved in the recent fatal shootings of Dijon Kizzee and Fred Williams. Department spokesman Lt. John Satterfield said deputies had recognized Padilla as being wanted on suspicion of attempted derailment of a passenger train. He was initially held on $1-million bail.

    Jorge Gonzalez, Padilla’s attorney, alleged that the charges have been inflated and that his client is being retaliated against for his protest activity. He’s also representing Padilla on a pending class-action lawsuit that claims the sheriff’s department engaged in unlawful arrests and excessive use of force at protests this summer against police killings of people of color.

    “It’s because they recognized him as a repeat protester,” Gonzalez said. “This is all about retribution.”

    Satterfield denied that portrayal.

    “Padilla’s arrest was absolutely in no way connected to his participation in protests or any exercise of his First Amendment rights,” he said in a statement.

    When asked about Gonzalez’s allegations, district attorney spokeswoman Pamela Johnson said in a statement, “we can’t discuss details until they are aired in open court.”

    At Monday’s arraignment, a representative for the district attorney’s office said that Padilla had admitted to dragging a barricade onto the tracks, knowing that a train was approaching. He said that when Padilla was asked what he thought could have happened if a train had made contact with the barricade, Padilla responded that it could have caused an electrical issue.

    The interrogation of Padilla was included in the detective’s report on the arrest. The account states that Padilla said he stopped pulling the cable when he realized it was on the tracks and could cause an accident.

    Gonzalez told The Times that Padilla’s alleged statement is “not proof of what his intent was.” While Gonzalez would not comment on whether Padilla had touched the cable, he said that it doesn’t appear there was “malicious” intent to derail a train.

    “I think the charges are as exaggerated as I have ever seen, your honor,” he told the judge. “He’s been targeted.”

    After learning from The Times that the alleged offenses occurred on the same day and location as a protest, Inspector General Max Huntsman said that he would request documentation from the sheriff’s department regarding the arrest.

    ”I believe this is a case which requires monitoring of LASD to ensure they are handling it in an objective and lawful manner,” he said in a statement.

    Padilla’s wife, Meagan Adams, alleges that an unexpected encounter she had with the sheriff’s department last Wednesday relates to her husband’s case, which she called “a farce.”

    Sheriff’s officials pulled Adams over as she was driving to go see Padilla in jail the evening of his arrest. She was arrested on suspicion of engaging in misconduct related to motor vehicle documentation and released the next day with a citation.

    The sheriff’s department would not comment as to the reason for the stop.

    The department obtained a warrant to search the couple’s home Wednesday night for property that included eight guns registered in Padilla’s name. (Adams said Padilla goes shooting as a hobby.) The department referred a question about the outcome of the search to the district attorney’s office, which would not comment.

    More than 40 people, some holding signs that said “Free Eman” gathered in front of Compton City Hall during a press conference Saturday.

    Maria Padilla, the defendant’s mother, spoke to the crowd.

    “He was only protesting, he wasn’t doing anything wrong,” she said in Spanish. “That’s a right we all have in this country.”

    Many friends of Padilla vouched for his character and described him, at more than 6 feet tall, as a “gentle giant.” Adams said that Padilla, who grew up in Compton, became particularly active in protests in the aftermath of George Floyd’s death.

    Exactly. Even the polics/DA's own statements pretty much sum up how trumped up this charge is to anyone reading as an outsider. At the very least you'd have to question. :x
