Actually, you can't - depending on the work of art. In Europe, the concept is referred to as artists' moral rights - and the rationale is that great works or art belong to all mankind so "owners" only hold them temporarily, in trust, for future generations to enjoy.

In the US of A, it's part of the copyright act, known as VARA for Visual Artists Rights Act, and it prohibits the destruction of "important" works of art. The Gargamel piece doesn't qualify - although in my opinion, I'd rather have it than Guernica - but the rationale for VARA is the same one being expressed here - some stuff shouldn't be wrecked even if you paid for it.

This is a newer concept in US law though, as is a lot of your freedoms being taken away as the copyright office bows down to content providers and crazy senators.... making our copyright law more like EU than the original concept of what US copyright was meant to do..
