Most of us on here deal with Paypal on a daily basis and understand their policies. If the seller is personable about your transaction, just let him know you'll open a dispute before day 45 comes around the bend. They should understand. Not only will this give the seller an extra 20 day grace period to ensure you get your item... but it'll keep you protected if you don't get it by the end up those 20 days, so long as you remember to open a case before day 20.
