What did he fabricate? And what was the lawsuit about?

I believe the lawsuit was about the fact that he used the original picture of Obama without authorization.

Our french friend is correct, He used the original time picture of Obama and made it into the "hope" logo. Ive got obey prints hanging on my walls, so it doesnt bother me, but he's been using photos as his photoshop backgrounds for years.

And the main issue here is that he used the photo and then claimed he hadn't and destroyed documents that showed he did. (If I understood the whole thing correctly)

yes, that's correct. he ended up settling the suit with the AP. it was incredibly dumb (and disappointing) of him to try and cover things up, since he would have almost certainly won the case based on fair use, but i guess he just panicked.

His contrition appears to be sincere, and his apology is downright eloquent in its admission that had he not destroyed evidence, he might have helped establish a better case for the fair use clause. A missed opportunity. But who among us hasn't done something stupid in a panic? The fact that he seems to be truly sorry probably helped to keep him out of jail. Glad it's over. The hefty fine he owes can be taken care of with the sale of a poster or two.

It's not that difficult chad.

It's a real shame that someone as known as Shepard Fairey had to be the guy this happened to, but hey, at least he can more than afford the charges and he's not going to jail over it all (I tend to think a lesser known artist may have). An example's been set though: make sure you're not violating any laws and for fuck's sake don't destroy evidence needed for your case.

Let's not forget that this is all the result of a lawsuit that Shepard instigated - HE sued the AP, after they claimed copyright infringement!! He sued them, knowing full well that they were right, then destroyed evidence during the discovery process.

Worst of all, his actions have opened the door to completely destroy the legal concept of fair use in the future.

He's a lying, thieving ass. I only wish he had been really punished, instead of this slap on the wrist.

Great article Coop thanks for tossing it out. I've never been a Fairey fan especially after seeing him snap at his wife on tmz. Makes the dude look like a total asshole.
